On July 1, 2014, federal legislation (commonly referred to as Canada’s Anti-Spam Legislation or “CASL”) came into force to regulate, among other things, the sending of commercial electronic messages, such as emails and text messages (collectively, referred to in this survey as “e-marketing messages”). 



On July 1, 2017, a “private right of action” under CASL will come into force, which will increase exposure to legal liability for most Canadian organizations.
The private right of action will permit anyone affected by a contravention of CASL to commence litigation proceedings and seek a monetary award.

Plaintiffs need not prove that they suffered any harm from the breach. Under the private right of action, CASL permits the court to award a pre-determined monetary penalty for each contravention of certain provisions in CASL, not exceeding $1,000,000 for each day on which a contravention occurred. Class action litigation activity is expected in this area given the potential for large awards without the need to prove any harm.

We are conducting a general survey in order to help organizations understand their anti-spam related obligations and exposure under CASL.  Please answer the following questions concerning your organization and CASL.  The survey should only take approximately 5 minutes to complete.  Responses will be reported on an aggregated basis only; your identity and particular responses will not be disclosed.
