9 Recommendations from The Office of the Privacy Commissioner of Canada

The Office of The Privacy Commissioner of Canada held an information session on August 11, 2016 to allow interested parties to have a closer examination of the circumstances and results of their first Compliance Agreement under CASL. While the entire session was informative a single slide jumped out at me. These are practical no nonsense or legal speak recommendations that any organization interested in CASL and PIPEDA compliance should heed:

At e10 egency, we have developed a full compliance process designed to ensure your organization is CASL compliant. It is a 5 stage compliance process:
1. Audit - a deep dive regarding current email and SMS text messaging.
2. Design - making as few chnages as needed to become compliant, we design your organizations program along side your team.
3. Document - we help document new Policies & Procedures
4. Technology - the most difficult part of CASL compliance is setting up data tracking in order to easily prove consent (your relationship with every individual on your email list). We have exceptional tracking technology in place.
5. Staff Training - we train and re-train your entire staff.

If your organization choses to complete these stages on your own, we would be happy to arrange a 'Third Party Audit' once you think the process is complete. Fresh, educated eyes never hurt. (see #9 on the OPC list)

In 11 months the private right to action kicks in and July 1, 2017 marks the end of the grace period to allow you to convert all exisiting email opt-ins to CASL compliant opt-ins. You still have time to get your email house in order. Take action now - not next June when it's too late.
